Hot Booths (“Hot Booths,” “we,” “our,” “us”) creates photo and video solutions for hybrid teams and events. Our web-based apps support business headshots, photo booth experiences, and user-generated video. When we work together, we collect some information about you to provide the highest quality user experience possible.

We want you (our “clients,” “user(s)”) to know that your privacy is important to us. That is why we have created this Privacy Policy (the “Privacy Policy”) to help you understand what information we collect about our clients, how we use it, and what choices you have about it. Because internet privacy concepts can be a little technical, we have tried our best to explain things in a simple and clear way. We welcome any questions and comments you may have about our Privacy Policy.

This Privacy Policy describes (unless a different privacy notice is displayed) our privacy practices regarding the personal information we collect from individuals in the usual course of business, including when you:

  • Visit our website (“Visitors”), https://hotbooths.com/ (the “Site”); and
  • Use any of the Hot Booths Products as a user, paying client, or an administrator (collectively “Users”)
"You" may, depending on the context, be a Visitor or a User of one or more of the Hot Booths Products.

What is “Personal Information”?

“Personal Information” is data that is capable of identifying an individual or household. “Aggregate Information” is not Personal Information because it excludes data that could help someone identify which individual or household it relates to or describes. As such, our Privacy Policy does not restrict our use of Aggregate Information.

What information do we collect?

You may voluntarily provide us with Personal Information through our website, such as when you request information or apply for a job. When you access or use our Site, it is your choice whether you would like to provide us with this information. Just know that you may not be able to use certain aspects of our Site, such as requesting information, without providing some Personal Information.

Users


You may voluntarily provide us with Personal Information when you use Hot Booths products, mostly likely when you take a photo, GIF, or video of yourself, and/or provide prompted information such as your name and email address. When you access or use our products, it is your choice whether you would like to provide us with this information. Just know that you will likely be unable to use our products without providing some Personal Information.

Purchases
Users

If you choose to purchase a Hot Booths product, we will likely need your billing information. The transaction may be handled by third parties who are responsible for processing your payment (“Payment Processors”). Payment Processors have their own privacy policies that apply to you. Please be sure to review them at the links provided during payment processing.

Automatically-Collected Information. 
We receive and store automatically-collected iformation about you such as the name of the domain and host from which you access the internet, the IP address of the computer you are using, the browser and operating system you are using, the date and time you access the Site, generalized demographic data, any search terms you used to find the Site, device identifiers and network information, and your actions in connection with the Site, among others.

Automatically-collected information, however, is not Personal Information unless we make an effort to combine it with identifying information, or if otherwise required by law. To the extent that this automatically-collected data includes, or is linked to, Personal Information, we will treat the data in accordance with this Privacy Policy. However, we anticipate rarely linking your Personal Information with identifying information as it is not part of our business practices.

Cookies.  You may have heard of “cookies” before but do not really know what they are or how they may affect your experience using our Site. Cookies are strings of text that a website may store on your computer to keep track of your visits and activity.  How do we use cookies?
  • Our Site creates session cookies to facilitate your visit, and they expire at the end of the session. 
  • We may also use persistent cookies, which can remain on your device for much longer but they do not corrupt or damage your computer or computer files.
  • We use analytics and customization cookies, including third party cookies, to gather information on how our Site is being used and to measure the popularity of our marketing campaigns. We use this data to learn about how you interact with our marketing efforts, including how many times the email is opened and/or clicked, the browser type used, operating system, user email program, etc. The cookie set by our service providers will remain on your hard drive 30 days after the last time you clicked on the coded link in the email, or until you delete it. We also use this data to help prevent fraud.
  • We may use social networking cookies to allow users to share our pages and content through third-party social networking websites.
  • We may use targeting/advertising cookies to help us customize and regulate (e.g., by capping the frequency of) the advertisements you receive, provide you with tailored offers, and measure the effectiveness of our advertising.   • You can control the use of cookies at the individual browser level. If you reject cookies, you may still use our Site, but your ability to use some features or areas of our Site may be limited.     Google Analytics: We use cookies served by Google Analytics to collect limited data directly from Users browsers to enable us to better understand your use of our products, including making use of the demographics and interests reports services of Google Analytics.     How do we use Personal Information?

    Usage. We may use Personal Information to do the following (unless doing so is restricted by law):
    • Communicate with you by email, regular mail, telephone, or mobile devices, about products or services;
    • Develop and deliver marketing emails with the assistance of third parties (see more information about marketing emails below);
    • Tailor your user experience;
    • Enforce our Terms of Use and our Terms & Conditions of the applicable contract agreement between the User and Hot Booths
    • Manage our business;
    • Notify you of changes to our products or services;
    • Send you information you have requested;
    • Process entries to a competition or promotion;
    • Display personalized advertisements and content;
    • Carry out obligations under any contract we have with you; or
    • Perform functions as otherwise described to you at the time of collection.
    • Analyze overall trends, to help us understand and improve our Site and products, and to improve their security and proper functioning.

    Storage. We generally store Personal Information only as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, provide our products as purchased by our clients, maintain business records, and as required under applicable law. You may request the deletion of your Personal Information at any time using the contact information provided under the “Contact Us” heading.

    Transfer. To fulfill your requests and operate our business, we may transfer your Personal Information from the United States to other countries or regions in connection with storage and processing of data. By using our Site or products and voluntarily providing us with your Personal Information, you consent to such storage, transfer, and processing.

    Marketing emails. We may use third party service providers to send our marketing emails. The emails may contain e-tags, which permits you to share the mail via certain social sites. In addition, the third parties that assist with our marketing emails may use pixel tags that help us send the email in a format you can read to allow us to know which emails you act upon and to better target the content of future emails. We also use these tags to track the aggregate number of emails read and whether any of the links in the email were accessed.

    Advertisements. Visitors We also may use third party service providers to serve and host our advertisements. You may receive our ads on these third-party sites. These third parties may use cookies to track the number of times our Site is accessed and whether the Site was accessed from the advertisement. You may opt out of receiving personalized advertisements from advertising companies that are members of the Network Advertising Initiative or who subscribe to the Digital Advertising Alliance’s Self-Regulatory Principles for Online Behavioral Advertising by visiting http://www.networkadvertising.org/choices and www.aboutads.info/choices.

    Do we share Personal Information with others?

    Sometimes we have to share Personal Information with others (such as when required by law), and other times we share Personal Information with third party service providers to enhance your experience using our Site and interacting with our business.

    As such, below are the ways we may share Personal Information with others:

    • We may share Personal Information with third party service providers that perform services or functions on our behalf (see more information about service providers below).
    • We may share Personal Information with Payment Processors to process payments.
    • We may share Personal Information with third parties, such as social media sites, so you can view our content through those sites.
    • We may share Personal Information as we believe is necessary to comply with applicable laws, statutes, or regulations, and/or to enforce this Privacy Policy, the Terms and Conditions, and to protect our rights and the rights of others.

    • We may share Personal Information as part of a transfer of our assets, for example in the event of a merger, acquisition, corporate change, or in the unlikely event of a bankruptcy, involving Hot Booths (see more information about business transactions below).
    • We may share Personal Information as you may otherwise request or agree.

    Service Providers. We use third party service providers for specific business support services, which may involve access to Personal Information. Examples of such services include sending emails, cloud hosting providers, providing customer service, performing business analysis, and processing payments. This Privacy Policy does not encompass the actions of service providers or other third parties, and Hot Booths is not responsible for any additional information you may directly provide them. These third-party service providers or vendors may use data we provide to them only as instructed by Hot Booths.

    Business Transactions. We may disclose your Personal Information as part of any merger, sale of company assets or acquisition, as well as in the event of an insolvency, bankruptcy or receivership. The recipient of Personal Information following such actions may have privacy policies that differ from those in this Privacy Policy. If this happens, we will notify you via email and/or a prominent notice on the Site, and you may opt-out of the use of your existing Personal Information.

    Special Events. If you choose to participate in a special event (for example, a promotion, contest, or sweepstakes), we may share your Personal Information with those organizations participating in the applicable event.

    Sharing with Paying Clients. 
Users
If a paying client purchases a Hot Booths product and opts to include lead capture or another feature that collects your Personal Information, we will share the information they choose to collect with that paying client. How the paying client chooses to use the information we share is out of Hot Booths’s hands, and Hot Booths takes no responsibility for the paying client’s handling of the information.

    How we protect your information.

    All of your Personal Information remains private and confidential. The security of your Personal Information is important to us.

    Hot Booths has a documented information security policy that we routinely update to keep apprised with industry standards and updates. Hot Booths utilizes only reliable, proven, and secure third-party partners, such as Google and Keen, to store and process your Personal Information. Automatically collected information is anonymized and kept secure on these platforms.

    As anything goes in the world, however, no method of transmission over the Internet, or method of electronic storage is perfectly secure. Therefore, we can’t guarantee your information’s absolute security. If you have any questions about security on our Site or our products, please contact us using the contact information below.

    Third-Party websites/applications.

    Our Site or Products may contain links to other websites/applications and other websites/applications may reference or link to our Site or Products. These third-party services are not controlled by us. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen or approve, and are not responsible for, the privacy practices or content of such other websites or applications. Visiting these other websites or applications is at your own risk.

    Your privacy rights.

    When acting as a controller, and depending on your location, your jurisdiction, and subject to applicable law, you may have the rights below with regard to the Personal Information we control about you. We will respond to your requests within the appropriate timeline under applicable law.

    • The right of access means that you have the right to request that we disclose what Personal Information we have collected, used and disclosed about you. You can do so at any time by contacting us using the contact details provided under the “Contact Us" heading below.
    • The right of deletion means that you have the right to request that we delete Personal Information collected or maintained by us, subject to certain exceptions. As mentioned above, you can do so at any time by contacting us using the contact details provided under the "Contact Us" heading below.
    • The right to non-discrimination means that you will not receive any discriminatory treatment when you exercise any of your privacy rights.
    • You can also ask us to correct or update your Personal Information; object to the processing of your Personal Information; ask us to restrict processing of your Personal Information or request the portability of your Personal Information. Again, you can exercise these rights by contacting us using the contact details provided under the "Contact Us " heading below.
    • You have the right to opt-out of marketing communications we send you at any time. You can exercise this right by clicking the “unsubscribe” link in the marketing e-mails we send you.
    • If we have collected and processed your Personal Information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Information conducted in reliance on lawful processing grounds other than consent.
    • Hot Booths does not engage in any automated decision making with Visitor or User Personal Information.
    • You have the right to complain to a data protection authority about our collection and use of your Personal Information. For more information, please contact your local data protection authority.

    Our policy on children’s privacy.

    Your children’s privacy is very important to us. Our Site or products are not directed at children, and we do not knowingly collect Personal Information directly from users under the age of 13 or from other websites or services directed at children.

    We promise to not knowingly request or collect Personal Information from any child under age 13 without first obtaining the required parental consent in a manner consistent with the Federal Children’s Online Privacy Protection Act of 1998 (“COPPA”).     What about the California residents?

    California law requires us to disclose additional information that relates to the privacy rights of California residents.


    Do Not Track.Under Section 22575 of the California Business & Professions Code, website and online service providers are required to disclose whether they honor web browser “Do Not Track” settings. Hot Booths does not support “Do Not Track” web browser settings. For more information about Do Not Track, please visit www.allaboutdnt.org.


    Note that “Do Not Track” settings are available to and applied the same to non-California residents.

    Requests about Disclosures of Personal Information. Effective January 1, 2005, California Civil Code Section 1798.83 requires businesses who have disclosed a California resident’s Personal Information (that was made available to the business for primarily personal, family, or household purposes) to a third party during the preceding calendar year to inform that California resident of the disclosure in writing, upon request.
